This document is published in accordance with Rule 3 (1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021 and other applicable laws requiring publication of Terms of Use for access or usage of https://decollection.in/ (“Website”) including related mobile site and mobile application (collectively, the “Platform”).

The Platform is owned by Dealdisha Enterprise Private Limited, incorporated under the Companies Act, 1956, having its registered office at:

ACCEPTANCE OF TERMS

Your use of the Platform, services, and tools is governed by these Terms and Conditions (“Terms of Use”) along with applicable policies incorporated herein by reference including:

  • Privacy Policy

  • Refund & Cancellation Policy

  • Return Policy

  • Shipping Policy

By mere use of the Platform, you contract with the Platform Owner and agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use the Platform.

These Terms may be modified at any time without prior notice. Continued use of the Platform constitutes acceptance of updated Terms.

TERMS OF USE

1. USER RESPONSIBILITY

You agree to provide true, accurate, and complete information during registration and transactions.

You are responsible for maintaining confidentiality of your account credentials and for all activities under your account.

2. NO WARRANTY

We do not guarantee accuracy, completeness, or suitability of information on the Platform.

Services are provided on an “as is” and “as available” basis without warranties of any kind.

3. RISK AND RESPONSIBILITY

Your use of the Platform is at your own risk.

You are responsible for evaluating whether the Services meet your requirements.

4. INTELLECTUAL PROPERTY

All content including design, layout, graphics, logos, and software is proprietary to Dealdisha Enterprise Private Limited.

Unauthorized reproduction, distribution, or misuse is prohibited.

5. UNAUTHORIZED USE

Unauthorized use may result in legal action under applicable Indian laws.

6. PAYMENT OF CHARGES

You agree to pay all applicable charges, taxes, and fees associated with your purchase.

7. PROHIBITED USE

You shall not:

  • Violate any applicable law

  • Engage in fraudulent transactions

  • Attempt unauthorized access

  • Interfere with Platform security

8. THIRD-PARTY LINKS

We may provide links to third-party websites for convenience.

We are not responsible for their content, policies, or practices.

9. LEGALLY BINDING CONTRACT

Once an order is placed and accepted, a legally binding contract is formed between you and Dealdisha Enterprise Private Limited.

10. ACCOUNT SUSPENSION / TERMINATION

We reserve the right to suspend, restrict, or terminate user accounts without prior notice if:

  • False or misleading information is provided

  • Fraudulent or suspicious activity is detected

  • Terms are violated

  • Misuse of Platform occurs

No liability shall arise for such suspension.

11. REFUND / RETURN / CANCELLATION

Refunds, returns, and cancellations shall be governed by our Refund & Cancellation Policy and Return Policy available on the Platform.

Orders may be cancelled only before dispatch, as per the Cancellation Policy.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Dealdisha Enterprise Private Limited shall not be liable for any indirect, incidental, special, or consequential damages.

Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

13. ELECTRONIC COMMUNICATION CONSENT

By using the Platform, you consent to receive communications electronically including:

  • Order confirmations

  • Transaction receipts

  • Policy updates

  • Promotional emails (with opt-out option)

Electronic communication satisfies any legal requirement that such communication be in writing.

14. DELIVERY / SHIPPING DISCLAIMER

Delivery timelines are estimates and may vary due to operational, logistical, or external factors.

We are not liable for delays caused by courier partners, incorrect addresses, or force majeure events.

15. INDEMNIFICATION

You agree to indemnify and hold harmless the Platform Owner and its officers, directors, employees, and affiliates from claims arising out of:

  • Breach of Terms

  • Violation of law

  • Infringement of third-party rights

16. FORCE MAJEURE

Neither party shall be liable for failure to perform obligations due to events beyond reasonable control including:

Natural disasters
Government restrictions
Strikes
Pandemics
Technical failures

17. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.

All disputes shall be subject to exclusive jurisdiction of courts in Kolkata, West Bengal.
